1. Who we are and what these terms cover

This website at mindsetcyber.com.au is operated by Mindset Cyber Pty Ltd (ABN 55 668 364 261) (Mindset Cyber, we, us, our), an Australian training company.

These Terms of Use (Terms) govern your use of this website and the courses, guides, and resources we sell or make available through it. By accessing this website or buying anything from us you agree to these Terms. If you do not agree, please do not use the website.

These Terms work together with our Privacy Policy and our Returns & Refunds Policy. If there is a direct conflict between this page and the Returns & Refunds Policy on a refund question, the Returns & Refunds Policy applies.

2. Using this website

You may use this website for personal and professional information about our courses and services. You agree not to:

  • Use the website in any way that breaches Australian or other applicable law.
  • Attempt to gain unauthorised access to any part of the website, our database, our email systems, or our service providers.
  • Use automated systems (scrapers, bots) to extract data beyond what a normal visitor would access, except for well-behaved search engine indexing.
  • Reproduce, republish, or redistribute substantial portions of this website without our written permission.
  • Use this website to send unsolicited messages or interfere with any other user.

3. Buying a course

When you buy a course from us through the Stripe checkout linked from this website, you enter a contract with Mindset Cyber for delivery of that course. Prices shown on this website are in Australian Dollars (AUD) and exclude GST unless we expressly say otherwise on the page. Where GST applies, it is calculated and added at Stripe checkout, and the GST-inclusive total is shown to you before you confirm payment.

A purchase is only complete when Stripe confirms your payment has succeeded and you have received our confirmation email. If a payment fails, no course is allocated and no charge is made.

By placing an order you confirm that the email address and other details you provide are correct. We rely on those details to enrol you, to communicate with you about the course, and to assign your PECB seat where applicable. If you provide incorrect details and a course is allocated to the wrong account, we may not be able to reassign it (see Section 4).

4. PECB courses, vouchers, and exam enrolment

The PECB courses we sell are delivered by PECB on the PECB platform (myPECB), under PECB’s own terms and conditions. When you buy a PECB course from us, we facilitate three things:

  • Course access: we assign the course to the PECB account email you nominate at checkout.
  • Exam voucher: PECB issues a voucher that allows you to sit the certification exam.
  • One free re-sit: included in the price you paid, subject to PECB’s own terms about timing and eligibility.

Once we have assigned a PECB course to the email you nominated and PECB has activated the course on your account, the course is considered accessed for the purposes of our Returns & Refunds Policy. From that point forward we cannot return the course to PECB and so we are unable to refund it. See our Returns & Refunds Policy for the full details.

It is your responsibility to provide the correct PECB account email at checkout. If you do not yet have a myPECB account, we will email you with a link to create one. If you spot an error in the email you provided, please reply to our confirmation email immediately — we will try to update the assignment if PECB has not yet allocated the course, but we cannot guarantee it.

PECB’s own terms and conditions govern the course experience inside the PECB platform, including exam scheduling, identity verification, and certification rules. You can find them at pecb.com.

5. Live online instructor-led training

Live online training courses are scheduled sessions delivered via Microsoft Teams. Payment confirms your place. Cancellation and refund terms for live training are set out in our Returns & Refunds Policy.

You are responsible for having a working internet connection, a quiet space, and any device you need to participate. We will provide the meeting link before the first session.

6. Account responsibilities

Where a service requires an account (such as the PECB platform or, separately, the Mindset Prep app), you are responsible for keeping your login details secure and for any activity on your account. You must not share your account credentials with anyone else. Course content licensed to you for individual use must not be shared, resold, or reused for commercial training delivery without written permission from Mindset Cyber and from PECB where the content is theirs.

7. Intellectual property

The content of this website — including text, images, the Mindset Cyber name, logo, and branding — is owned by Mindset Cyber or used under licence. PECB course materials, the PECB logo, and PECB exam content are owned by PECB. Course materials we provide alongside live training are licensed to you for personal study only.

You may not reproduce or republish substantial portions of any material we provide without our written permission. Short quotes for legitimate review, commentary, or educational purposes with attribution are fine.

8. Third-party services

This website and the courses we sell rely on third-party services including Stripe (payments), Microsoft (email and Teams), Cloudflare (hosting), Supabase (database), n8n Cloud (workflow automation), Google Analytics, Google Ads, Microsoft Clarity (analytics), PECB (course platform), and Mindset Prep (our sub-brand exam-practice app). Each of those services has its own terms and privacy notices, summarised in our Privacy Policy. Your use of those services through links on this site is also subject to their terms.

9. Disclaimer

We work hard to make the information on this website accurate and up to date, but the website is provided “as is”. We do not warrant that:

  • The website will be available without interruption.
  • The website will be free of bugs, errors, or viruses.
  • Any specific outcome (for example, passing an exam) will result from a course you purchase, although we make every reasonable effort to set you up for success.

10. Limitation of liability

To the maximum extent permitted by law, our total liability to you arising out of or in connection with this website or a course you purchase from us is limited to the amount you paid for the course in question. We are not liable for indirect, consequential, special, or incidental loss (such as lost profits, lost opportunities, or third-party claims) except where that liability cannot be excluded by law.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that applies under the Australian Consumer Law or other applicable consumer protection laws and that cannot lawfully be excluded.

11. Termination

We may suspend or terminate your access to this website, or to a course we sold you, if you materially breach these Terms or the PECB terms, including by sharing course materials or attempting to defraud us. Any refund in those circumstances is at our discretion and subject to our Returns & Refunds Policy.

12. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any dispute will be dealt with in the courts of New South Wales or the relevant federal court of Australia, and you and we submit to the jurisdiction of those courts.

13. Changes to these Terms

We may update these Terms from time to time. The current version, and the date it was last updated, will always be available at this URL. Material changes will be flagged at the top of the page. By continuing to use the website after a change you accept the updated Terms.
